The Website is operated by Spectrum Pool Care, a California corporation (“Spectrum Pool Care,” “we,” “us,” or “our”).

By accessing or using the Website, you agree to these Terms. If you do not agree with these Terms, please do not use the Website.

1. WEBSITE INFORMATION

The Website provides general information about Spectrum Pool Care and the pool service and repair services we may offer.

Information on the Website is provided for general informational purposes. Website content does not constitute a binding estimate, service agreement, warranty, professional engineering opinion, or guarantee that a particular service is available or appropriate for your property.

Descriptions of services, service areas, qualifications, pricing, promotions, and availability may be changed at any time without notice.

2. REQUESTS FOR SERVICE

You may use the Website to request information, ask a question, or inquire about pool service or repair.

Submitting a form, sending an email, or calling us does not create a service contract and does not guarantee that we will accept or perform the requested work.

A service relationship begins only after Spectrum Pool Care and the customer agree to the applicable services and terms. Additional written estimates, work authorizations, service agreements, or other conditions may apply.

You agree that the information you provide to us will be accurate and that you will not impersonate another person or provide information you are not authorized to provide.

3. EMERGENCIES AND HAZARDOUS CONDITIONS

The Website is not an emergency-reporting service and is not monitored continuously.

Do not use the Website to report an electrical emergency, gas leak, fire, suspected drowning hazard, serious chemical exposure, or other immediate danger. Contact the appropriate emergency service or utility provider.

If you believe someone has been exposed to pool chemicals or may have been poisoned, contact emergency services or the appropriate poison-control resource promptly.

4. POOL AND EQUIPMENT INFORMATION

Pool systems involve electricity, water, pressurized equipment, chemicals, gas-fired appliances, pumps, heaters, and other potentially hazardous components.

Website information should not be treated as a substitute for an onsite inspection by a qualified professional. Conditions vary from one property and pool system to another.

Do not rely exclusively on Website information when handling chemicals, repairing equipment, modifying electrical or gas systems, or making decisions involving personal safety or property protection. Always follow product labels, equipment-manufacturer instructions, applicable laws, and appropriate safety procedures.

5. PERMITTED USE

You may use the Website only for lawful, personal, and legitimate business purposes related to learning about or requesting our services.

These links are provided for convenience only. Spectrum Pool Care does not control and is not responsible for third-party websites, content, security, availability, or privacy practices.

A link does not necessarily mean that Spectrum Pool Care endorses or is affiliated with the linked organization. Your use of a third-party website is governed by that website’s own terms and policies.

10. COMMUNICATIONS

If you contact us through the Website, by email, or by telephone, you authorize us to respond using the contact information you provide. We may contact you regarding your inquiry, appointment, estimate, requested work, existing service, account, or another customer-service matter.

Spectrum Pool Care does not use the Website to enroll visitors in SMS marketing. We do not send marketing text messages based solely on the submission of a Website inquiry.

Ordinary telephone calls, appointment-related messages, or individually written responses concerning a service request are not SMS marketing programs.

You may ask us to stop sending nonessential promotional emails, if any, by using the unsubscribe instructions in the email or by contacting us. We may still send communications reasonably necessary to administer requested or existing services.

11. NO ONLINE PAYMENTS

Spectrum Pool Care does not process payments through this Website.

If payment arrangements are made separately, they will be governed by the applicable invoice, service agreement, payment instructions, and terms provided in connection with those services.

Never submit credit-card or bank-account information through a general Website contact form or ordinary email unless Spectrum Pool Care has specifically provided a secure and authorized method for doing so.

12. WEBSITE AVAILABILITY AND ACCURACY

We try to maintain useful and accurate Website information, but we do not guarantee that the Website will always be available, uninterrupted, secure, complete, current, or error-free.

Nothing in these Terms excludes or limits liability that cannot lawfully be excluded or limited. Liability arising from services actually performed may also be governed by a separate written estimate, work authorization, warranty, or service agreement.

15. INDEMNIFICATION

To the extent permitted by law, you agree to defend, indemnify, and hold harmless Spectrum Pool Care and its owners, officers, employees, agents, and service providers from claims, liabilities, damages, losses, and reasonable expenses arising from your unlawful use of the Website, your violation of these Terms, or information or material you submit through the Website.

This section does not require you to indemnify Spectrum Pool Care for conduct for which indemnification cannot legally be required.

16. PRIVACY

Our collection and use of personal information through the Website are described in our Privacy Policy. The Privacy Policy is incorporated into these Terms by reference.

17. CHANGES TO THE WEBSITE OR THESE TERMS

We may update the Website or these Terms from time to time.

When we revise these Terms, we will update the “Last Updated” date at the top of this page. Changes become effective when the revised Terms are posted, unless a later date is stated.

Your continued use of the Website after revised Terms become effective constitutes acceptance of the revised Terms.

18. GOVERNING LAW AND VENUE

These Terms are governed by the laws of the State of California, without regard to conflict-of-law principles.

To the extent permitted by law, any legal action arising solely from the use of the Website shall be brought in a state or federal court having jurisdiction in Los Angeles County, California.

This section does not alter any rights, venue requirements, or dispute procedures that cannot lawfully be waived. A separate service agreement may contain additional dispute-resolution provisions applicable to services performed.

If any provision of these Terms is found to be unlawful, invalid, or unenforceable, that provision will be enforced to the greatest extent permitted by law or severed if necessary. The remaining provisions will remain in effect.

20. NO WAIVER

A failure by Spectrum Pool Care to enforce a provision of these Terms does not waive our right to enforce that provision or any other provision later.

21. ENTIRE AGREEMENT REGARDING WEBSITE USE

These Terms and the Privacy Policy constitute the entire agreement between you and Spectrum Pool Care concerning your use of the Website.

They do not replace a separate estimate, work authorization, service agreement, invoice, warranty, or other agreement governing pool service or repair work.
